Public Liability

What is a public place?
A public place could include:
- Supermarkets, car parks, or other commercial properties;
- Footpath and malls;
- Public playground and sports fields, childcare centre, school grounds;
- Movie theatres;
- Someone else’s home.
Who is eligible to make a claim?
You need to have been injured in a public place as a result of another person or entity’s fault or negligence. You will need to prove that the other person or entity owed you a duty of care and that duty was breached, causing you to suffer your injuries. Working out if someone owed you a duty of care is not always easy, so it is important that you contact us as soon as possible after you have been injured. We can then gather the evidence needed and provide you with advice on whether you have a claim.
If you have been bitten by an animal (for example a dog attack), you may also be eligible for a victims of crime compensation claim.
What if the accident was partly my fault?
You may still be able to claim compensation if the incident was partly your fault. The amount may be reduced by the percentage that was your fault. We will explain more at your first interview.
What sort of compensation can I claim?
You can claim for compensation including:
- Pain and suffering;
- Past and future lost wages;
- Medical expenses, including the costs of medication, treatment and surgery;
- Your future care needs.
How long do I have to make a claim?
You need to provide notice of a claim to the person or entity at fault within 6 months after your injury. We will draft and send this notice on your behalf. If your claim does not resolve within 3 years of the date of your injury, you will need to issue legal proceedings. For a child who has been injured, they must issue proceedings before their 21st birthday.
